Terms and Conditions of Sale

1. PURPOSE

These General Terms and Conditions of Sale (hereinafter referred to as "T&Cs") define the rights and obligations between MAYBIJOU ECLAT, registered with the Paris Trade and Companies Register under number 448 598 656, with its registered office located at 131, rue du Temple - 75003 Paris, and any individual or legal entity (hereinafter "the Customer") making a purchase on the website www.eclatparisbijoux.com (hereinafter "the Site").


The Site is operated by MAYBIJOU ECLAT and hosted by Shopify Inc., 126 York St. Ottawa, ON K1N 5T5, Canada.


Any order placed on the Site constitutes full acceptance of these T&Cs. The applicable T&Cs are those in effect on the date of the order and may be modified at any time.



2. PRODUCTS

The products offered for sale on the Site are stainless steel jewelry items, subject to stock availability.


We strive to present our products as accurately as possible. However, minor variations may occur between product images and the actual product delivered. These differences do not constitute grounds for liability on the part of MAYBIJOU ECLAT.



3. PRICE

Prices are displayed in euros (€), inclusive of all taxes (VAT), excluding delivery fees.
VAT applied is that in force on the day of the order.
In the event of a VAT rate change, prices may be updated without prior notice. The total price, including delivery charges, is shown before the final order confirmation.

MAYBIJOU ECLAT reserves the right to change prices at any time, but products will be billed according to the prices in effect at the time of the order confirmation.

In case of an obvious pricing error (technical issue, display mistake, etc.), MAYBIJOU ECLAT reserves the right to cancel the order and inform the Customer.



4. ORDER

4.1 Order process

The Customer selects the desired products, adds them to the cart, and confirms the order after verifying the details (quantities, options, shipping information, etc.).
The order becomes binding once:

- Payment has been confirmed, and

- An order confirmation email has been received.

The sales contract is deemed concluded once the confirmation email is received.


4.2 Availability of products

If an item becomes unavailable after order confirmation, the Customer will be informed by email and may choose a replacement product or request a full refund.



5. PAYMENT

Payment is made online via the following methods:

- Credit card (Visa, Mastercard, American Express)

- PayPal
Payments are securely processed through our payment provider.
In case of failed payment, the order may be canceled.



6. DELIVERY

6.1 Delivery times and methods

Orders are shipped within 24 to 48 working hours after payment confirmation.

Deliveries are handled by Colissimo, Chronopost, or Mondial Relay with tracking.

Estimated delivery times:

- Pickup point: 3 to 7 business days

- Standard: 2 to 4 business days

- Express: 1 to 2 business days


6.2 Errors or delays in delivery

MAYBIJOU ECLAT is not liable for delivery delays due to carriers or incorrect addresses provided by the Customer. For any delivery issues, please contact us at: contact@eclatparis.com


6.3 Customs charges

Orders shipped outside the European Union may be subject to customs duties or taxes, which remain the sole responsibility of the Customer.


7. RETURNS & REFUNDS

7.1 Right of withdrawal

The Customer has 14 days from receipt of the order to exercise their right of withdrawal, without the need to provide any reason.


7.2 Return conditions

Returned items must:

- Be unworn and in perfect condition

- Be sent back in their original packaging (pouch, box, tag)

- Be returned at the Customer’s expense

Refunds will be processed using the original payment method within 14 days after receipt and inspection of the items.


7.3 Defective Product

Any defect must be reported by email within 2 days of receipt. Beyond this timeframe, claims may be declined.


7.4 Return procedure

1. Send an email to contact@eclatparis.com with your order number and the item in question.

2. Wait for instructions and the return address.

3. Once the return is received and inspected, the refund will be processed within 7 days.

Please note: We do not accept in-person returns.



8. FORCE MAJEURE

MAYBIJOU ECLAT shall not be held liable for any delay or failure to perform due to an event of force majeure such as strikes, pandemics, natural disasters, or interruption of logistics or IT services.


9. INTELLECTUAL PROPERTY

All content on the Site (texts, visuals, logos, photos, etc.) is protected by copyright laws. Any reproduction, whether in part or in full, without prior written authorization is strictly prohibited.


10. LIABILITY

MAYBIJOU ECLAT shall not be liable for any indirect damages resulting from the use of the Site or purchased products. Unless otherwise required by law, liability is limited to the total value of the order.


11. DISPUTES & APPLICABLE LAW

These T&Cs are governed by French law.

In case of a dispute, we encourage you to first contact our customer service via email (contact@eclatparis.com) to seek an amicable resolution.
In accordance with article L.612-1 of the French Consumer Code, the Customer may also use a consumer mediator service free of charge.

If no amicable agreement is reached, the dispute will be submitted to the competent courts in Paris, including in cases of multiple defendants or third-party notices.
